Terms & conditions
- 1.1
- The term "HouseHuggie" shall refer to HouseHuggie, its successors and authorized representatives, acting on behalf of HouseHuggie Services.
- 1.2
- The term "Client" shall denote the Client (or any authorized representative of the Client) identified in any quotation, work authorization, or similar document provided by HouseHuggie Services to the Client.
- 1.3
- The "Guarantor" refers to the individual(s) or entity that undertakes to be responsible for the Client's debts on a primary debtor basis, as outlined herein.
- 1.4
- "Items" encompass all Materials, Equipment, Workmanship, or Services furnished by HouseHuggie Services to the Client at the Client's request, including any counsel, suggestions, data, or programming delivered to the Client (where suitable, the terms 'Items' or 'Services' may be used interchangeably).
- 1.5
- The "Cost" shall signify the price of the Items as mutually established by HouseHuggie Services and the Client, following the terms set forth in clause 5 below.
- 2.1
- When you engage the services and/or procure materials ("Goods") from HouseHuggie Services, you ("the Client") acknowledge your agreement to abide by the subsequent terms and conditions.
- 2.2
- In instances where multiple Clients are party to this agreement, they shall collectively and individually assume responsibility for all payments associated with the Price.
- 2.3
- Once the Client has accepted these terms and conditions, they become binding and may only be modified with the written consent of HouseHuggie Services.
- 2.4
- The Client commits to providing HouseHuggie Services with a minimum of fourteen (14) days' notice regarding any alterations to the Client's name, address, or any other modifications to the Client's particulars.
- 2.5
- In cases where fulfilling any contract with the Client necessitates HouseHuggie Services to obtain Goods from a third party, the contract between HouseHuggie Services and the Client will incorporate and be subject to the terms governing the provision of said Goods to HouseHuggie Services. The Client shall be held responsible for the entire cost of such Goods.
- 3.1
- The determination of the Price by HouseHuggie services shall be subject to one of the
following options:
- a)
- As outlined in invoices presented by HouseHuggie for the Goods supplied to the Client; or
- b)
- The Price quoted by HouseHuggie Services (subject to clauses 3.2 and 3.3), which shall be binding upon HouseHuggie Services provided that the Client acknowledges HouseHUggie Services' quotation in writing within thirty (30) days.
- 3.2

HouseHuggie Services retains the right to adjust the Price if there is a modification to
the initial quotation.
- a)
- Parking Fees - HouseHuggie Services will make every effort to park in cost-free areas. However, if parking charges are incurred, these expenses will be directly transferred to the client and incorporated into the revised quotation or invoice
- 3.3
- In cases where a quotation has been presented to the Client without a written brief and/or inspection by HouseHuggie Services of the involved materials, HouseHuggie maintains the right to furnish a revised quotation if necessary.
- 3.4
- HouseHuggie Services may, at its sole discretion, require a deposit.
- 3.5
- Compliance with the stipulated payment timeline for the Goods is crucial and will be indicated on the invoice or other relevant documents. If no specific timeframe is mentioned, payment will be due within seven (7) days from the invoice date.
- 3.6

As determined by HouseHUggie Services at its sole discretion:
- a)
- Full payment shall be made upon the completion of the Works ("Goods"),
- b)
- Payment shall be due before the delivery of the Goods. 3.7 Payment methods accepted include cash, credit card, or bank deposit. 3.8 Unless expressly included in the Price, GST, and any other applicable taxes and duties, shall be added to the Price as required by law.
- 4.1
- HouseHuggie Services and the Client mutually acknowledge that ownership of the Goods
shall not transfer until:
- a)
- The Client has settled all outstanding amounts owed to HouseHuggie Services for the specific Goods; and
- b)
- The Client has fulfilled all other responsibilities owed to HouseHuggie Services concerning all contracts between HouseHuggie Services and the Client.
- 4.2
- The receipt of any payment method other than cash by HouseHuggie Services shall not constitute payment until such payment has been validated, cleared, or acknowledged. Until that point, HouseHuggie Services' ownership or rights pertaining to the Goods shall remain intact.
- 4.3
- It is additionally agreed that:
- a)
- When feasible, the Goods shall be kept separate and identifiable until HouseHuggie Services has received payment and all other Client obligations have been met
- b)
- HouseHuggie Services holds the authority to issue written notice to the Client, requesting the return of the Goods or any portion thereof, at any time before ownership is transferred. Upon receiving such notice, the Client's entitlement to ownership or any other interest in the Goods will be terminated
- c)
- HouseHuggie Services possesses the right to halt the Goods during transit, regardless of whether delivery has occurred
- d)
- In the event of the Client's failure to return the Goods to HouseHuggie Services, HouseHuggie Services or its agent may enter and seize the Goods from any land or premises owned, occupied, or used by the Client, or any premises where the Goods are located as the invitee of the Client
- e)
- The Client functions solely as a custodian of the Goods. Until HouseHuggie Services has received full payment for the Goods, any proceeds obtained from the sale or disposal of the Goods, up to the total amount owed by the Client to HouseHuggie Services for the Goods, are held in trust for HouseHuggie Services
- f)
- The Client shall not engage in any actions that may be detrimental to HouseHuggie Services regarding HouseHuggie Services' funds
- g)
- The Client shall not encumber the Goods or confer any interests in the Goods while they remain the property of HouseHuggie Services
- h)
- HouseHuggie Services retains the right to initiate legal action to retrieve the Price of the Goods sold, even if ownership has not yet been transferred to the Client
- i)
- Until ownership of the Goods is transferred to the Client, if the Goods are transformed into other products, both parties concur that HouseHuggie Services will be the owner of the end products.
- 5.1
- Before initiating the Works, the Client is required to inform Beachside Handyman Services about the exact positions of all subsurface utilities at the site and clearly designate them. The underground mains and services that the Client is obligated to identify encompass, but are not restricted to, electrical services, gas services, sewer services, pumping services, sewer connections, sewer sludge mains, water mains, irrigation pipes, telephone cables, fiber optic cables, oil pumping mains, and any other services that might exist on the site.
- 5.2
- Although Beachside Handyman Services will exercise utmost caution to prevent harm to underground services, the Client accepts the responsibility to hold Beachside Handyman Services harmless for any liability claims, losses, damages, expenses, and penalties resulting from harm to services that were not precisely located and reported in accordance with clause 1
- 6.1
- The Client acknowledges the requirement to provide written notice to HouseHuggie Services, detailing any claims of defects or non-compliance with the agreement between the HouseHuggie Services staff representative and the Client, within seven days following the delivery or completion of the works. Should the Client fail to furnish such notice within the aforementioned timeframe, then, in accordance with applicable law, the works are considered as accepted by the Client. Consequently, all claims against HouseHuggie Services pertaining to the works are nullified, and the Client is obligated to remunerate HouseHuggie Services for the completed works.
- 6.2
- If the Client has reasonable dissatisfaction with the completed works, the Client agrees
to grant HouseHuggie Services an opportunity to rectify these works. In cases where the
Client declines or obstructs Beachside Handyman Services from addressing the works
within seven days of notifying HouseHuggie Services in writing about the specific
defect, HouseHuggie Services, to the extent allowed by law, shall bear no responsibility
toward the Client. Consequently, the Client is obligated to settle all invoices in full
to HouseHuggie Services. The terms governing the warranty outlined in clause 6.1
encompass the following conditions:
- a)
- The warranty shall not encompass any defect or damage that may result from
or partly result from:
- i)
- The Client's failure to adequately maintain the Goods;
- ii)
- The Client's disregard of any instructions or guidelines provided by Beachside Handyman Services;
- iii)
- The use of the Goods for purposes other than those specified in a quotation or order form
- iv)
- The continued use of the Goods after a defect becomes evident or would have become evident to a reasonably prudent operator or user;
- v)
- Normal wear and tear, accidents, or acts of nature.
- b)
- The warranty shall cease, and Beachside Handyman Services shall not be held liable under the warranty terms if the workmanship is altered, repaired, or overhauled without the consent of Beachside Handyman Services.
- c)
- Regarding all claims, Beachside Handyman Services shall not be liable for compensating the Client for any delays in replacing or rectifying the workmanship or in properly assessing the Client's claim.
- 6.3
- For Goods not manufactured by HouseHuggie Services, the warranty shall align with the prevailing warranty offered by the Goods' manufacturer. HouseHuggie Services shall neither be bound by nor assume responsibility for any terms, conditions, representations, or warranties beyond those provided by the Goods' manufacturer.
- 7.1
- A cancellation charge of $60 could be imposed in the event that written notification is not conveyed to HouseHuggle Services via email with less than 48 hours' notice
